FAQ No. 1: FREE SEEDLINGS

Q: How do clients request for Free Seedlings/Planting Materials?
There are two ways to request free seedling/planting materials.
1. For walk-in clients, they need to accomplish and submit a Request Form to the officers-in charge at the PFMS Office, DENR-NCR Techical Services Compound, North Avenue, Diliman, Quezon City.
2. For scheduled pick-up of seedlings, they need to send a formal request letter addressed to the Office of the Regional Executive Director (ORED) containing the following information:
a. Name, address, and contact details of the requestee;
b. Type and quantity of seedlings; and,
c. Purpose of request.

Q: How long does it take for a request to be approved?
1-2 working days upon receipt of Request Letter/Request Form
Q: Where should clients follow-up their request?

Q: What type of seedlings/planting materials can clients request?
Clients can request seedlings of hardened indigenous tree species, fruit-bearing trees, and ornamental plants.
FAQ No. 2: ENTRY PERMIT AND AUTHORITY TO CONDUCT ACTIVITIES AT THE LAS PIÑAS- PARAÑAQUE WETLAND PARK (LPPWP)

Q: What are the requirements for Entry Permit/Authority to Conduct Activities at the LPPWP?
Request Letter and/or duly accomplished Request Form
Q: How long does it take to process approval of Entry Permit/ Authority to conduct Activities?
Requests must be filed at least five (5) working days before the scheduled visit and/or conduct of activity. Processing of requests are done during official working hours/days.
Q: Will DENR-NCR provide assistance to visitors in the conduct of their activities?
Yes. LPPWP staff will guide/assist the clients during their visit and conduct of activities in the area.
Q: Are the services free of charge?
Yes. But visitors are required to strictly follow rules while in LPPWP.
Q: Where should clients follow-up on approval of their Entry Permit/Authority to conduct Activities?

FAQ No. 3: LEGAL CERTIFICATES

Q: What types of Legal Certificates can a client request from the Legal Division?
Clients may request for any of the following:
1. Certificate of Finality;
2. Certificate of No Motion for Reconsideration or Appeal Filed;
3. Certification of No Pending Case;
4. Certification of Receipt of Legal Documents on File
Q: How can clients request for a Certificate?
Clients must submit a fully accomplished pro-forma Request Form or Letter-Request to the Regional Executive Director or Chief of the Legal Division specifying the type of document requested and purpose of the request.
Q: How long does it take for a Certificate to be issued?
Provided that all the requirements and information submitted by the client is complete, the requested Certificate may be issued with- in the day of filing.
Q: Are there fees involved in requesting for Certificate?
Certificates are issued free of charge. Requesting party, however, will have to shoulder the reproduction of required documents.
FAQ No. 4: FILING OF LEGAL CLAIMS AND DISPUTE RESOLUTION

Q: How can a client file a claim over (a) parcel/s of public land, or a protest against a public land titling application?
Clients or their duly authorized representative may file a claim or Verified Protest against the land titling application of another party, directly with the Legal Division. (Note: representatives must present a notarized Special Power of Attorney from the claimant).
Q: What are the requirements for filing a Verified Protest?
Pursuant to Section 4 of DAO 2016-31, a Verified Protest must be:
1. In written form;
2. Clear, simple, brief and concise language in either Filipino or English;
3. Contains the names of the parties;
4. Address of the parties;
5. Material allegations;
6. Grounds relied upon; and,
7. Documentary and other forms of evidence to support the allegations.

In addition, the Verified Protest must be accompanied with the following:
1. Certificate to file action from the barangay concerned, if applicable (issued in the name of both parties);
2. Verification and Certification of Non-Forum Shopping;
3. Proof of Payment of the Protest Fee; and,
4. A recent 2x2 picture of the Protestant (Claimant) and his or her duly authorized representative and the subject lot/s.

The Verified Protest and its supporting documents, moreover, must be filed in three (3) copies.

Note: It is important that the complainant submit all the required documents, otherwise the Legal Division will not have jurisdiction over the case and lead to its dismissal.
Q: Are there any payments involved in filing a case?
Yes. A client seeking legal redress must pay a Protest Fee of PhP 50.00 to the DENR-NCR Cashier and attach the Official Receipt to the Verified Protest as proof of payment.
Q: How could clients follow up on the status of their complaint/ protest?
Clients may either write a Letter-Request or directly call the Legal Division to inquire on the latest status of their case during office hours (Monday to Friday | 8:00 a.m. to 5:00 p.m.).
How long does it take to resolve a legal claim or conflict?
Resolution of claims and conflicts falls under Process No. 04 of Service Excellence through Continuous Systems Innovation Monitoring and Evaluation (SECSIME).

The approximate period for resolving land claims and conflicts is ten (10) months. However, there are times when it takes longer as when either parties of the case decides to file related proceedings such as Alternative Dispute Resolution (ADR), Clarificatory/Preliminary Conference, and Conduct of Investigation, which are mandatory and allowed by law.

FAQ No. 5: CERTIFICATE OF LAND STATUS AND/OR CERTIFICATE OF SURVEY CLAIMANT

Q: What are the requirements for the issuance of Land Classification Status?
The following are the requirements for the issuance of land classification status:
1. Duly accomplished form FM-SMD-03;
2. Muniments of title which can be any or combination of Tax declaration, Deed of Sale, Existing Lot Plan, Proposed Lot Plan, copy of title, copy of plans, among others;
3. Blueprint copy of plan with geographic position;
4. Documentary stamp; and,
5. Payment of the Certification fee.
Q: How much is the Documentary Stamp Tax and Certification Fee?
Documentary Stamp Tax costs PhP 25.00 while Certification Fee is PhP 50.00 per lot
Q: How long does it take to process and prepare the Certificate of Land Status/Survey Claimant?
If the subject land/lot is not involved in any legal dispute, the Certificate may be issued within two (2) days after filing and acceptance request. Otherwise, processing may take as long as a week.
FAQ No. 6: SURVEY AUTHORITY

Q: What are the requirements for the issuance of Survey Authority?
The following are the requirements for the issuance of land classification status:
1. Duly accomplished form FM-SMD-04; Other documents as may be required by the geodetic engineer/ case handler; and
Payment of the inspection fee
2. Muniments of title which can be any or combination of Tax declaration, Deed of Sale, Existing Lot Plan, Proposed Lot Plan, copy of title, copy of plans, among others;
3. LLDA clearance and/or affidavit of 2 disinterested persons (if applicable);
4. Other documents as may be required by the geodetic engineer/ case handler; and,
5. Payment of the Field Inspection Deposit.
Q: How much is the Field Inspection Deposit?
Field Inspection Deposit is computed as follows: (11 x H) + ( 1 x K) + 110 where H = area in hectares per survey plan; (a fraction of a hectare is considered one hectare) and K = road network distance in kilometers of the survey site from the provincial district office or the official station of inspector
Q: How long does it take to process and issue the Survey Authority?
3 days minimum (more depending on the location and size of the area subject of the Survey Authority)

Client must submit an original copy of the Complete Survey Returns
Q: Do clients have to pay for the inspection, verification and approval of survey plans?
Yes. An inspection fee of PhP 50.00 is required.
Q: How long does the inspection, verification and approval of survey plans take?
The whole process would at least take 15 days, 3 hours & 54 minutes
Q: What should the client do if there are errors in e-surveyplan application?

FAQ No. 8: CERTIFIED BLUEPRINT COPY OF PLANS, LOT DATA COMPUTATIONS, LOT DESCRIPTION AND OTHER DOCUMENTS

Q: What are the requirements for the issuance of certified survey records?
The following are the requirements:
1. Duly accomplished form FM-SMD-02;
2. Muniments of title (Tax declaration, Deed of Sale, Existing Lot Plan, Proposed Lot Plan, Copy of title, copy of plans, among others, as may be required);
3. For representatives of requesting party, a Special Power of Attorney (SPA) must also be submitted;
4. For restricted plans, copy of court order; and
5. Payment of certification fee.
Q: How much is the Certification Fee?
Yes. An inspection fee of PhP 50.00 is required. Client will shoulder cost of reproduction of survey plans, etc.
Q: How long does the inspection, verification and approval of survey plans take?
Approximately 2 days, 4 hours & 10 minutes
FAQ No. 9: CERTIFIED TECHNICAL DESCRIPTION

Q: What are the requirements for the issuance of Certified Technical Description?
The following are the requirements for the issuance of Certified Technical Description:
1. Duly accomplished form FM-SMD-01;
2. For titled property, copy of title | For untitled property, muniments of title which can be any or combination of Tax declaration, Deed of Sale, waiver of rights, among others;
3. Barangay certification of actual occupancy;
4. For corporations, secretary’s certificate;
5. For Homeowner Associations (HOAs), certification from the association;
6. Blueprint copy of plan;
7. Lot description or lot data computation;
8. Special Power of Attorney for authorized representative (if owner is no the requester); and,
9. Payment of certification fee.
Q: How much is the payment for Certified Technical Description?
The fee for Certified Technical Description is PhP 25.00.
Q: What are the requirements if the lot owner has already died?
If the owner has already died, the legal representative may present the owner’s death certificate and/or will, waiver of rights/ extrajudicial settlement of estate between heirs or other notarized documents to establish legal claim.
Q: How long does the inspection, verification and approval of survey plans take?
7 days, 4 hours & 10 minutes
FAQ No. 10: VERIFICATION SURVEY

Q: What are the requirements for the conduct of verification survey?
The following are the requirements for the conduct of Verification Survey:
1. Original court order for verification survey;
2. Muniments of title which can be any or combination of Tax declaration, Deed of Sale, Existing Lot Plan, Proposed Lot Plan, Copy of title, copy of plans, among others;
3. Barangay certification of actual occupancy;
4. Other documents as may be required by the geodetic engineer/ case handler; and,
5. Payment of Verification Survey fee.
Q: How much is the Verification Survey Fee?
Verification Survey Fee is PhP 800.00 per lot.
Q: How many days will the conduct of verification survey take?
16 days, 3 hours & 25 minutes.(excluding approval of plan).
FAQ No. 11: CERTIFICATE OF WILDLIFE REGISTRATION (CWR)

Q: What are the requirements for the issuance of a Certificate of Wildlife Registration (CWR)?
The following are the requirements for the issuance of CWR:
1. Duly accomplished/filled-up CWR Application Form with attached 2 x 2 ID picture;
2. Document/s supporting the legal acquisition of the wildlife (fauna) species:
a. If wildlife species was acquired from wildlife permittees of DENR-NCR (Wildlife Farm Permittees and Certificate of Wildlife Registration holders with updated quarterly breeding report supporting that the wildlife species disposed are progenies of registered wildlife species), the client is required to submit the following:
• Sales Invoice/ Official Receipt
• Notarized Deed of Sale or Deed of Donation
b. If wildlife species acquired from wildlife permittees outside of NCR, the original copy of the Local Transport Permit (LTP) issued by the corresponding DENR-PENR Offices with attached Official Receipt /Sales Invoice or duly notarized Deed of Sale/Deed of Donation must be submitted. c. Payment of CWR Fee
Q: How much is the payment for CWR?
PhP 50.00 for 1-50 heads
PhP 500.00 for 51-100 heads
PhP 750.00 for 101-200 heads
PhP 1000.00 for 200 heads and above.
Q: Do clients need to bring the wildlife species to the WRPS for inspection?
Inspection of wildlife species being applied for CWR is necessary, hence, if it’s feasible we encourage the client to bring the wildlife to the Office to verify/validate the actual species being applied. If in case client cannot bring the wildlife to the office for inspection (for whatever valid reasons: e.g., number of heads, location, etc.), on-site inspection will be considered.
Q: How long does the processing and issuance of CWR take?
4 days, 6 hours & 5 minutes (Additional 1 day in case Inspection is done at the facility/residence of the applicant)
FAQ No. 12: LOCAL TRANSPORT PERMIT (LTP)

Q: What are the requirements for the issuance of an Local Transport Permit (LTP)?
The following are the requirements for the issuance of an LTP:
1. Duly accomplished/filled-up LTP Application Form with attached 2 x 2 ID picture;
2. Document/s supporting the legal acquisition of the wildlife (fauna) species (e.g., Sales Invoice or Official Receipt/Notarized Deed of Sale/Donation;
3. Pythosanitary Certificate for plants or Veterinary Quarantine Certificate for animals
(Note: Applicant must secure after the issuance of the LTP)
4. Payment of LTP fee
Q: How much is the payment for LTP?
Fee for LTP is PhP 100.00
Q: Do clients need to bring the wildlife species to the WRPS for inspection?
Inspection of wildlife species being applied for CWR is necessary, hence, if it’s feasible we encourage the client to bring the wildlife to the Office to verify/validate the actual species being applied.

If in case client cannot bring the wildlife to the office for inspection (for whatever valid reasons: e.g., number of heads, location, etc.), on-site inspection will be considered.

4 days, 6 hours & 5 minutes (Additional 1 day in case Inspection is done at the facility/residence of the applicant)
FAQ No. 13: TREE CUTTING/PRUNING/BALLING PERMIT

Q: What are the requirements for the issuance of a Tree Cutting/ Pruning/Balling Permit?
The following are the requirements for the issuance of Tree Cutting Permit:
1. Submission of application letter;
2. Endorsement or Certificate of No Objection from concerned Local Government Unit (Barangay/City or Municipal Hall);
3. If land concerned is privately owned, copy of Original Certificate of Title/Transfer Certificate of Title (1 certified copy or 1 photocopy with accompanying owner’s copy)
4. If requesting party is school/organization, PTA Resolution or Resolution from any organized group stating No Objection and Reason for Cutting (1 original)
5. Replacement Seedlings as fee
Q: Is there a fee for Tree Cutting/Pruning/Balling Permit?
There is no charge for Tree Cutting/Pruning/Balling Permit but every tree approved for cutting must be replaced with 50 seedlings if planted and 100 seedlings if naturally grown.
Q: How much is the seedlings? Can clients pay in cash instead of replacement seedlings?
DENR has no idea on the prices of seedlings. Paying cash in lieu of the seedlings is not allowed.
Q: How long does the processing and issuance of Tree Cutting/ Pruning/Balling Permit?
10 days 5 hours and 30 minutes (Note: Application must be filed and duly received by the FUS. Applications with incomplete requirements will not be accepted).
FAQ No. 14: CHAINSAW PERMIT

The following are the requirements for the issuance of Chainsaw Permit:
1. Original copy of Official Receipt of Chainsaw Purchase:
2. Stencil Serial Number of Chainsaw;
3. Duly accomplished Chainsaw Permit Application Form
4. Detailed Specification of Chainsaw (e.g. brand, model, engine capacity, etc.);
5. Original copy of Notarized Deed of Absolute Sale, if transfer of ownership;
6. Actual chainsaw (for inspection purposes);
7. Payment of Chainsaw Permit Fee

FAQ No. 15: APPROVAL OF LUMBER SUPPLY CONTRACT

Q: What are the requirements for the approval of Lumber Supply Contract?
The following are the requirements for the issuance of Lumber Supply Contact:
1. Authenticated copy of business registration as single proprietorship, partnership or corporation from DTI or SEC (for new buyer/s only);
2. Copy of permit ( supplier and buyer if both permittee);
3. Business Permit (buyer only); and,
4. Validated Monthly or Quarterly latest report of the supplier
Q: Is there any fee involved?
No fees will be collected.
Q: How long does the approval of Lumber Supply Contract take?
6 hours and 34 minutes (Note: Application must be filed and duly received by the FUS. Applications with incomplete requirements will not be accepted).
FAQ No. 16: CERTIFICATE OF REGISTRATION AS LUMBER DEALER

Q: What are the requirements for the issuance of a Lumber Dealer Certificate?
The following are the requirements for the issuance of Lumber Dealer Certificate:
1. Duly signed application form;
2. Lumber Supply Contract (1 original)
3. Two (2) pictures (Office with signage/ and Lumberyard/stock area;
4. Photocopy of mayor’s permit;
5. Annual business plan;
6. Copy of annual Income Tax Return; and,
7. Fees and Bonds
a. Oath, application + Registration Fee (PhP 1,116.00)
b. Cash bond (P1, 000.00) or surety bond
Q: How long does the processing and issuance of Lumber Supply Contract take?
New Application: 2 days 2 hours and 32 minutes

Renewal: 1 day 2 hours and 32 minutes

FAQ No. 17: COMPLIANCE MONITORING OF TREE CUTTING/EARTH-BALLING AND PRUNING PERMITS (FOR SEVERAL TREES INVOLVING INFRASTRUCTURE/ GOVERNMENT PROJECTS)

Q: What is the client’s next step after approval of Tree Cutting/ Pruning/Earth-Balling Permit?
Client must coordinate with the Conservation and Development Division (CDD) for the seedling replacement, and the Enforcement Division (ED) for the schedule of technical conference on the terms and conditions stipulated in the permit.
Q: Does DENR-NCR provide cutting/pruning/earthballing services?
No. DENR-NCR only monitors the conduct of the activity, in accordance with the approved terms and conditions in the issued permit. Client has to hire a private service provider/contractor.
Q: Does DENR-NCR sell seedlings for replacement?
No. The office only accepts the seedling replacement and disposes/ distributes/gives them to government and private entities and individuals for various conservation projects.
Q: What if I miss/violate any of the terms and conditions stipulated in my permit?
Violation of any conditions in the permit shall be sufficient ground for its cancellation/revocation without prejudice to the imposition of penalties in accordance with applicable law, rules and regulations.
Q: What will happen to the cut logs?
If the property involved in the permit is private, the cut logs will be given to the owner. Otherwise, the cut logs will be turned over to the DENR-NCR for proper disposition.
FAQ No. 18: INVESTIGATION OF COMPLAINTS FOR VIOLATION OF PD NO. 705, AS AMENDED, PD NO. 953, RA NO. 9147, RA NO. 9175 AND OTHER ENR LAWS

Q: Where can clients report suspected illegal activities concerning wildlife and/or tree cutting?
To the Enforcement Division at telephone number 8420-6744, or to This email address is being protected from spambots. You need JavaScript enabled to view it., or to the Field Offices of the DENR-NCR. The Office is mandated to protect and conserve the environment and natural resources.
Q: How can a client report or file a complaint?
Clients and other concerned citizens may file a written complaint, or through telephone at 8 420-6744 or on the DENR-NCR Facebook account.
Q: What happens after clients file a report/complaint?
The Records Clerk puts information on blotter and refers to the Chief, Enforcement Division. The Chief then evaluates and refers the matter to the Surveillance and Intelligence Section, for appropriate action.
Q: Will the identity of the complainant be revealed?
As a general rule, yes, unless the client will request anonymity.
Q: How do the client check the status of his/her complaint?
Client will be notified in writing on the status of his/her complaint.
Clients may also contact the office for the status of his/her complaint.
FAQ No. 19: RETRIEVAL AND RESCUE OF WILDLIFE

Q: What can a concerned citizen do if he/she finds an ill, injured or abandoned wildlife?
Consider safety first. Never attempt to handle wildlife unless you are certain that you can do so, without any harm to yourself or to the wildlife.

Q: Is there a fee for requesting assistance in retrieval of wildlife?
FAQ No. 20: VERIFICATION/INSPECTION OF IMPORTED FOREST PRODUCTS AND AUTHENTICATION OF IMPORT DOCUMENTS
Q: What are the requirements and its corresponding fees?
Requirements:
a. Phytosanitary Certificate

c. Commercial Invoice
d. Packing List
e. BOC Import Entry and Export Declaration
Fees:
Certification fee is PhP 36.00 per page (amount may vary depending on the number of pages to be authenticated) + Documentary stamps
Q: Is an Official Receipt issued for Certification fee?
Yes, Official Receipt is issued upon payment at the Cashier’s Office, DENR-NCR Bldg. National Ecology Center, East Ave., Quezon City.
FAQ No. 21: REQUEST FOR TRANSPORT DOCUMENTS/ CERTIFICATE OF VERIFICATION

Q: What are the requirements needed and fees to be paid, if there is any?
Requirements:
1. Letter Request;
2. Certificate of Transport Agreement (if vehicle to be used is not owned by the shipper);
3. Copies of Original Receipt (OR) and Certificate of Registration (CR) of vehicle to be used for transport of forest products;
4. Sales Invoice/Delivery Receipt (for Lumber dealers, wood processing plant owners, importers of wood materials, furniture shops, etc.);
5. Authenticated import documents (for wood materials importers/dealers);
6. Affidavit of Personal Use (for non-DENR permittee consignee of old used lumber/furniture);
7. Terminal Report (for logs/lumber derived from tree cutting activity with approved permit);
8. Barangay Certificate (for non-DENR permittee consignee of old used lumber/furniture);
9. Documentary Stamp; and,
10. Special Power of Attorney/Written Authorization (1 original, notarized), if applied by a representative

FAQ No. 23: COMPLIANCE MONITORING FOR THE APPLICATION OF NEW OR RENEWAL OF PERMIT TO SELL CHAINSAW

Requirements:
1. Memorandum of the Chief, Licenses Patents and Deeds Division with attached application for renewal/new Permit to Sell chainsaw; and,
2. Summary Report of Purchases and Disposition.

FAQ No. 24: COMPLIANCE MONITORING FOR THE RENEWAL OF CERTIFICATE OF REGISTRATION AS LUMBER DEALER OR IMPORTERS/DEALER OF WOOD MATERIALS AND WOOD PROCESSING PLANTS PERMITS
