DENR National Capital Region through its South Field Office (SFO), confiscated an illegally converted chainsaw used to cut trees in Barangay Marcelo Green, Paranaque City. The SFO personnel found out, that the chainsaw does not have the necessary legal documents from the DENR.
Section 7, par. 1 of Republic Act No. 9175 or “Chainsaw Act of 2002” prohibits the sale, purchase, re-sale, transfer, distribution, or possession of a chainsaw without a permit from DENR. Those found guilty of the charge may suffer imprisonment of four (4) years, two (2) months, and one (1) day up to six (6) years or a fine of not less than Fifteen thousand pesos (P15,000.00) but not more Thirty thousand pesos (30,000.00) or both at the discretion of the court. Pars. 3 and 4 of the same prohibit tampering of Engine Serial Number of chainsaw and use of chainsaw without a permit to cut trees or timber respectively.
The case was endorsed to the Legal Division of the regional office for filing of appropriate charges.
